1. Agreement to Terms

By accessing or using ProWebCare's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

ProWebCare provides website maintenance, optimization, security, and related services for WordPress and Joomla websites. Our services include but are not limited to:

  • Regular updates to core, plugins, and themes
  • Automated backups and security monitoring
  • Performance optimization and speed improvements
  • Security audits and malware removal
  • Website redesign and development services
  • Technical support and consultation

3. Service Plans and Billing

Subscription Plans

Our maintenance plans are billed monthly on a recurring basis. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

One-Time Services

One-time services (such as speed optimization, security audits, or redesigns) are billed upon completion or according to the agreed payment schedule.

Payment

All fees are due as specified in your service agreement. We accept payment through secure third-party processors. Late payments may result in service suspension.

4. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about your website and requirements
  • Grant necessary access credentials for service delivery
  • Maintain backups of your content (we provide backups, but you should also maintain your own)
  • Notify us of any changes that may affect service delivery
  • Comply with all applicable laws and regulations

5. Service Level Agreements

Response times vary by plan:

  • Essential Plan: Email support within 24 hours
  • Professional Plan: Priority support within 12 hours
  • Premium Plan: Emergency response within 4 hours

While we strive to meet these response times, they are not guaranteed and may vary based on issue complexity and volume.

6. Limitation of Liability

ProWebCare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you for services in the 12 months preceding the claim.

7. Security Guarantee

While we implement industry-standard security measures, we cannot guarantee that your website will never be compromised. If your site is hacked while under our maintenance and we cannot fully restore it from backup, we will provide a refund for the current month's service fee. This does not cover damages beyond service fees.

8. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

Refunds: Refunds for one-time services are considered on a case-by-case basis. Monthly subscription fees are non-refundable except as specified in our Security Guarantee.

9. Intellectual Property

You retain all rights to your website content. Any custom code or configurations we create for you become your property upon full payment. We retain the right to use anonymized, aggregated data for service improvement purposes.

10. Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through our website. Continued use of our services after changes constitutes acceptance of the new terms.
